02About Us and Our Role
Fly Me Travels and Tours operates the Site as an intermediary/travel agent. Except where the Site expressly states that a product or service is sold directly by the Operator, we act solely as agent for the Third-Party Providers in relation to all products and services offered for sale on the Site, and the Contract for any such product or service is formed directly between you and the relevant Third-Party Provider.
All content on the Site, including its layout, design, compilation, graphics, text and software, is the intellectual property of the Operator and/or its licensors and Third-Party Providers, and is protected under the Copyright Act 2022 and other applicable Nigerian intellectual property legislation.
03Eligibility and Account Registration
You must be at least 18 years of age, or the age of legal majority in your jurisdiction of residence, and have the legal capacity to enter into binding contracts under Nigerian law, to use the Site or make a Booking.
Where registration is required, you will be issued a user ID and password. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- maintain only one active account at any time;
- notify us immediately upon becoming aware of any unauthorised use of your account or any other breach of security; and
- log out of your account at the end of each session, particularly where you are using a shared or public device.
The Operator shall not be liable for any loss or damage arising from your failure to safeguard your login credentials.
04Acceptable Use of the Site
You agree that, in using the Site, you shall not:
- make any speculative, fraudulent or false Booking, or any reservation in anticipation of demand;
- provide false, misleading or fabricated information, including in respect of email headers, sender information or any communication transmitted through the Site;
- copy, reproduce, republish, distribute or create derivative works from any content on the Site otherwise than for personal, non-commercial use, or as expressly permitted under the Copyright Act 2022;
- reverse engineer, decompile, disassemble or attempt to derive the source code of any software forming part of the Site, except to the extent such restriction is prohibited by applicable Nigerian law;
- introduce any virus, malware, worm, trojan horse or other harmful code, or otherwise interfere with the proper functioning of the Site, an act which may additionally constitute an offence under the Cybercrimes (Prohibition, Prevention, etc.) Act 2015;
- post or transmit any unlawful, defamatory, obscene, threatening or fraudulent material, or material that infringes the rights of any third party; or
- use the Site in a manner that violates any applicable Nigerian law, regulation or the rights of any other person.
You shall be solely liable for any loss, damage or liability arising from your breach of this clause, including any infringement of intellectual property rights or applicable law.
05Bookings, Contracts and Payments
You may place Bookings or make purchases of travel products and services through the Site. A binding Contract is formed once your Booking is confirmed and accepted, whether by the Operator or the relevant Third-Party Provider. You agree that a Contract concluded in electronic form on the Site is valid, binding and enforceable, and you waive any objection to its validity solely on the ground that it was concluded electronically, consistent with the recognition of electronic records and transactions under Nigerian law.
You are solely responsible for verifying that all details of your Booking (including names, dates, timings and travel classes) are accurate before completing payment. Once a Booking is confirmed, the Operator and the relevant Third-Party Providers are entitled to rely on the information you have submitted, and neither shall be liable for errors arising from inaccurate information provided by you.
Full payment must be made before any ticket, voucher or confirmation is issued. We accept payments through the channels indicated on the Site, which are processed in compliance with applicable CBN guidelines on electronic payments and consumer protection in the Nigerian payments system. Where a payment is declined or fails, you will be notified promptly and should contact your card issuer, provide an alternative payment method, or adjust the mode of payment as necessary.
Any error identified on a Booking or ticket must be reported within four (4) hours of receipt of the relevant travel document or itinerary.
06Pricing
All prices displayed on the Site are quoted in Nigerian Naira (NGN) unless otherwise stated, and are subject to change based on Third-Party Provider policies, availability, applicable taxes, levies and currency fluctuations until full payment is received. Prices, fare conditions, routing restrictions and classes of travel may change at any time without notice prior to full payment, in accordance with the applicable Third-Party Provider's own terms.
07Changes, Amendments and Cancellations
Changes and cancellations to a Booking are subject to the rules of the relevant airline or Third-Party Provider and may attract penalties or additional charges. Where no specific terms apply to a product or service, requests to amend or cancel a Booking should be directed to our Sales and Customer Care Team by telephone or email. Email requests will typically be responded to within three (3) business days. Requests for changes must reach us at least seven (7) days before the date of travel or use to be actionable, and may be subject to administrative fees, which you agree to bear.
- Where the price of a ticket has not been paid in full, any increase in airfare, taxes or levies will be communicated to you and charged accordingly.
- Where the price of a ticket has not been paid in full, the Booking remains subject to cancellation by the airline or the Operator without prior notice.
- Certain tickets are non-refundable but may be reusable subject to the applicable airline's rules; partially utilised tickets are non-refundable.
- No refund is available in respect of a "no show".
- A transaction-processing fee, as displayed on the Site at the time of booking, applies to any full refund due to a customer.
- You may generally amend or cancel a flight booking up to twenty-four (24) hours before departure, subject to the applicable airline's policy; certain carriers restrict cancellations between twenty-four (24) and seventy-two (72) hours before departure. Please review the applicable cancellation policy before submitting a cancellation request.
For further assistance with amendments or cancellations, please contact our Customer Care Centre using the details in Clause 21 below.
08Refund Policy
Refunds are processed in accordance with the applicable Third-Party Provider's policies. Air ticket refunds are typically processed within an estimated three (3) to six (6) months, and pre-paid hotel refunds within approximately one (1) month, from the date of submission of the relevant request; these timelines are indicative only and are not binding on the Operator, as they depend on the processing times of the relevant Third-Party Provider and financial institutions. You agree to bear the full cost of any booking, cancellation and administrative fees applicable to products or services booked but not utilised, in addition to any fees imposed by the relevant Third-Party Provider.
Nothing in this clause affects your statutory rights as a consumer under the Federal Competition and Consumer Protection Act 2018, including your right to a refund, replacement or repair where a service is not rendered as represented, or your right to escalate an unresolved complaint to the FCCPC.
09Third-Party Travel Service Providers
Many products and services made available through the Site, including flights, hotels, car hire, cruises and insurance, are supplied by independent Third-Party Providers. Your use of such products and services will also be subject to the terms and conditions of the relevant Third-Party Provider, including their conditions of carriage and cancellation policies, which you should read carefully.
The Operator is not liable for the non-performance, delay or unsatisfactory performance of any Third-Party Provider, including overbooking or rescheduling of flights by an airline. Where a Third-Party Provider fails to perform its obligations, your recourse in the first instance is against that Third-Party Provider, without prejudice to any right you may have against the Operator for our own acts or omissions.
10Travel Documents, Visas and Health Requirements
You are solely responsible for ensuring that you hold a valid passport, visa (including any transit visa), health certification and any other travel documentation required for your journey. Many destinations require a passport with a minimum of six (6) months' validity remaining beyond the intended date of travel. Information provided by the Operator regarding travel documentation, visa or health requirements is offered in good faith as a guide only, and does not constitute legal or immigration advice. You should verify current requirements with the relevant embassy, consulate or competent authority before travel.
The Operator reserves the right to decline any Booking for any lawful reason and shall not be liable for any resulting loss, damage or claim arising from such refusal.
11Intellectual Property
All content on the Site, including text, graphics, logos, icons, images, audio and video clips, digital downloads, data compilations and software, is owned by, or licensed to, the Operator and is protected under the Copyright Act 2022, the Trademarks Act, and other applicable Nigerian intellectual property law. Save as expressly permitted under these Terms or by applicable law, no part of the Site may be reproduced, distributed, modified or exploited without the Operator's prior written consent.
12Limitation of Liability and Disclaimer
To the fullest extent permitted by Nigerian law, the Operator shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Site, any Booking made through it, or the acts or omissions of any Third-Party Provider, whether such liability arises in contract, tort (including negligence), strict liability or otherwise, even where the Operator has been advised of the possibility of such damages.
Nothing in these Terms shall be construed to exclude or limit liability for death or personal injury caused by the Operator's negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Nigerian law, including relevant provisions of the Federal Competition and Consumer Protection Act 2018.
The Operator does not warrant that the Site will be uninterrupted, secure or free of viruses or other harmful components, and shall not be liable for any damage to your device or data arising from your access to or use of the Site.
13Indemnification
You agree to indemnify and hold harmless the Operator, its officers, employees and agents from and against any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these Terms, your violation of any applicable law, or your infringement of any third-party right.
14Data Protection and Privacy
The Operator processes your personal data in accordance with the Nigeria Data Protection Act 2023 and its subsidiary regulations. Details of the categories of personal data we collect, the purposes of processing, your rights as a data subject (including the right of access, rectification, erasure and to lodge a complaint with the Nigeria Data Protection Commission), and our data retention practices are set out in our Privacy Policy, which forms part of these Terms. By using the Site, you consent to the collection, processing and, where necessary, transfer of your personal data as described in the Privacy Policy, including transfers to Third-Party Providers for the purpose of fulfilling your Booking.
15Links to Third-Party Sites
The Site may contain links to third-party websites that are not maintained or controlled by the Operator. Such links are provided for your convenience only and do not constitute an endorsement of the content of those sites. The Operator has not reviewed all linked websites and is not responsible for their content, privacy practices or terms of use. You access any linked website entirely at your own risk.
Third parties wishing to link to the Site must obtain the Operator's prior written consent, and no third party may deep-link to any page other than the homepage without such consent. The grant of permission for a link does not obligate the Operator to establish a reciprocal link.
16Force Majeure
The Operator shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemic or pandemic, war, terrorism, civil unrest, government action, strikes, airspace closures, or failure of Third-Party Providers, and any obligations affected by such an event shall be suspended for the duration of the event.
17Governing Law and Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
The parties shall in the first instance attempt to resolve any dispute amicably through the Operator's Customer Care Team. Where a dispute cannot be resolved amicably within a reasonable time, the parties may refer the dispute to arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act 2023, or, at the election of either party, submit to the non-exclusive jurisdiction of the courts of the Federal Republic of Nigeria. Nothing in this clause prevents a User from lodging a complaint with the Federal Competition and Consumer Protection Commission (FCCPC) or another competent regulatory body.
18Amendments to These Terms
The Operator reserves the right to amend or update these Terms at any time, at its sole discretion and without prior notice, by posting the revised Terms on the Site. Your continued use of the Site following such amendment constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
19Suspension and Termination
The Operator may suspend or terminate your access to the Site or any Booking at any time, with or without cause, including for breach of these Terms or misuse of the Site. Termination shall not affect any accrued rights or liabilities of either party, or any provision of these Terms that is intended by its nature to survive termination, including Clauses 11 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification) and 17 (Governing Law and Dispute Resolution).
20Severability, Waiver and Entire Agreement
If any provision of these Terms is held by a court or arbitral tribunal of competent jurisdiction to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. No failure or delay by the Operator in exercising any right under these Terms shall operate as a waiver of that right.
These Terms, together with our Privacy Policy and any product- or service-specific terms referred to herein, constitute the entire agreement between you and the Operator in relation to your use of the Site, and supersede all prior agreements or understandings, whether oral or written, relating to the same subject matter.
